Terms & Conditions
These Terms & Conditions ("Terms") govern your use of gottrev.com, the LeverageOS platform, and related services provided by GottRev LLC ("GottRev," "we," "us," or "our") (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
GottRev provides revenue-systems software and managed services for businesses, including the LeverageOS platform and related consulting, configuration, and support. Client engagements are additionally governed by the applicable service agreement or order form; if these Terms conflict with a signed agreement, the signed agreement controls.
2. Eligibility
The Services are intended for business use by individuals who are at least 18 years old and able to form a binding contract. By using the Services on behalf of a company, you represent that you have authority to bind that company to these Terms.
3. Accounts & Access
You are responsible for maintaining the confidentiality of any credentials or access codes provided to you and for all activity under your account. Notify us promptly of any unauthorized use.
4. Text Messaging (SMS/MMS) Terms
GottRev offers text messaging for appointment reminders, booking confirmations, customer care, account and service notifications, and — where you have expressly opted in — marketing messages.
- Opt-in. You consent to receive text messages by providing your mobile number and opting in through our forms, booking flows, or in writing. Consent to receive marketing texts is not a condition of purchasing any goods or services.
- Message frequency varies based on your interaction with us.
- Message and data rates may apply, depending on your mobile plan.
- Opt out at any time by replying STOP to any message. You may receive a single final message confirming your opt-out.
- Support. Reply HELP to any message, or email hello@gottrev.com.
- Carriers are not liable for delayed or undelivered messages.
- Privacy. Mobile information and text-messaging opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
5. Acceptable Use
You agree not to misuse the Services, including by: violating any applicable law or regulation (including telemarketing and messaging laws such as the TCPA when using any messaging features we provide); attempting to gain unauthorized access to systems or data; interfering with the operation of the Services; or using the Services to send unlawful, deceptive, or harassing communications. You are responsible for obtaining any consents required to contact your own leads and customers through systems we configure for you.
6. Intellectual Property
The Services — including software, content, branding, module names, and design — are owned by GottRev or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services as intended. You retain ownership of your own business data; you grant us the rights needed to host and process it in order to provide the Services.
7. Third-Party Services
The Services interoperate with third-party platforms (for example, telephony, payment, and scheduling providers). We are not responsible for third-party services, and your use of them is subject to their own terms.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, GOTTREV DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GOTTREV DOES NOT GUARANTEE ANY PARTICULAR BUSINESS RESULTS, REVENUE OUTCOMES, OR UNINTERRUPTED, ERROR-FREE OPERATION.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GOTTREV WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO THE SERVICES. GOTTREV'S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO GOTTREV FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS ($100) IF YOU HAVE PAID NOTHING.
10. Indemnification
You agree to indemnify and hold GottRev harmless from claims arising out of your use of the Services in violation of these Terms or applicable law, including messaging and telemarketing laws applicable to communications with your own customers.
11. Termination
We may suspend or terminate access to the Services for violation of these Terms. Client engagements terminate as provided in the applicable service agreement. Sections that by their nature should survive termination (including Sections 6, 8, 9, and 10) survive.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the latest revision. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
